1. General Provisions
1.1. A citizen of the Republic of Belarus, a natural person registered in the Republic of Belarus (hereinafter — the "Service Provider"), publishes a public offer (hereinafter — the Agreement) for the provision of services for creating personalized audio fairy tales for children in online format, addressed to an indefinite group of persons1.
1.2. The Service Provider's identification details (full name, Individual Taxpayer Number (UNP), passport data) constitute personal data of a natural person and are protected in accordance with applicable personal data legislation:
Law of the Republic of Belarus No. 99-Z dated 07.05.2021 "On Personal Data Protection" (Articles 6, 8) — general regime;
Federal Law of the Russian Federation No. 152-FZ dated 27.07.2006 "On Personal Data" (Article 6) — for Customers from the Russian Federation;
Regulation (EU) 2016/679 (GDPR), Article 6(1)(f) — for Customers from the European Union.
Such data is provided to the Customer upon a justified written request sent to legal@tailes.me, within 10 (ten) business days from the receipt of the request.
1.3. The Agreement is entered into by the Customer joining the Agreement by accepting its terms as a whole, without any exceptions or reservations.
1.4. The Service Provider is governed by the Civil Code of the Republic of Belarus, the Law of the Republic of Belarus No. 90-Z dated 09.01.2002 "On Protection of Consumer Rights"2, the Law of the Republic of Belarus No. 99-Z dated 07.05.2021 "On Personal Data Protection"3, and other regulatory acts of the Republic of Belarus.
1.5. The Services are provided remotely via the Telegram messenger and the Internet. The Service is available to Customers from various countries, subject to the technical and legal restrictions of the respective jurisdictions. The Customer independently ensures compliance with the laws of their country when using the Service.
1.6. For Customers from the Russian Federation, Federal Law No. 152-FZ dated 27.07.2006 "On Personal Data"4 and Law of the Russian Federation No. 2300-1 dated 07.02.1992 "On Protection of Consumer Rights"5 additionally apply. For Customers from the European Union, the GDPR (EU 2016/679)6 additionally applies.
1.7. The Service Provider has the right to amend the Agreement, with amendments becoming effective from the moment of publication on the Website. Continued use of the Services constitutes consent to such amendments.
1.8. If payment is made before amendments are introduced, the Customer's silence within 10 (ten) calendar days after the publication of the amendments shall be deemed consent to and acceptance of the new version of the Agreement.
1.9. The Parties warrant that they have sufficient legal capacity. The Customer must be of legal age (18+) or use the Service with the consent of a parent (legal guardian).
Definitions
Customer — a natural person ordering the Services for themselves or for a minor (hereinafter the "minor"), who has entered into the Agreement by acceptance — pressing the "Confirm and pay" button or another consent button in the Telegram bot @tailesmebot and/or paying for the Services via Telegram Stars.
Service Provider — Operator tAIles.me. Full definition is provided in clause 1.1 of the Agreement.
Services — creation of personalized audio fairy tales for children, delivered via the Telegram bot @tailesmebot.
Website — https://tailes.me
Acceptance — full acceptance of the offer by the Customer, expressed by one of the following means: (a) pressing the consent button in the Telegram bot; (b) paying for the Services via Telegram Stars.
Telegram Stars — internal digital units of the payment infrastructure of the Telegram messenger, used by the Customer to pay for the Services.
Telegram — a messenger and technology platform providing communication channels and payment infrastructure. Telegram is not a party to this Agreement.
Materials — audio recordings, texts of fairy tales, video recordings, and other results of the provision of Services.
Intellectual Property — rights to the Materials, Website, logos, design, programs, databases, and trade secrets of the Service Provider.
Confidential Information — any part of the Services, Materials, technologies, methodologies, algorithms, and commercial and financial information of the Service Provider.
Package (package tariff) — a tariff plan with a one-time payment giving the Customer a predetermined volume of AI fairy tales at a discount, valid for 60 (sixty) calendar days from the date of payment.
2. Acceptance
2.1. The following acts constitute acceptance of this offer:
pressing the consent button by the Customer in the Telegram bot @tailesmebot at registration or before placing an order; and/or
payment by the Customer for the Services via Telegram Stars using the payment infrastructure of the Telegram messenger.
2.2. On the day of acceptance, the Parties are deemed to have entered into a paid services agreement.
2.3. The Service Provider has the right to suspend the conclusion of agreements for a specific type of Services. Any funds received are refunded within 30 calendar days in accordance with Section 9 of the Agreement and the rules of the Telegram payment infrastructure.
3. Role of Telegram and Payment Infrastructure
3.1. Telegram is an independent technology platform and payment infrastructure used by the Customer and the Service Provider for communication and payment for the Services.
3.2. Telegram is not a party to this Agreement and is not responsible for the content of the Services provided by the Service Provider.
3.3. The Service Provider does not control the operation of Telegram, Fragment, or other elements of the messenger's infrastructure and is not responsible for:
failures, interruptions, or changes in the operation of Telegram and its payment infrastructure
changes in rules, fees, exchange rates, or other conditions on the part of Telegram
blocking of the Customer's account by Telegram
processing times for payments and refunds determined by Telegram's rules
3.4. Use of Telegram is governed by the applicable rules and policies of Telegram, available at https://telegram.org/tos and https://telegram.org/privacy.
4. Services. Price and Payment
4.1. The Service Provider creates unique audio fairy tales in which the main character is the Customer's child. The tales are voiced by professional AI voices or by live actors. The Services are provided remotely through the Telegram bot @tailesmebot. The Services are not subject to licensing.
4.2. Service Fees. The primary currency for settlements is Telegram Stars (hereinafter — "Stars"). Values in U.S. dollars (USD) and Belarusian rubles (BYN) are given solely as an approximate equivalent for the Customer's convenience and may differ from the actual cost depending on the Stars exchange rate set by Telegram and the currency exchange rate on the date of payment.

* USD and BYN values are an approximate equivalent. Approximate exchange rate: 1 USD ≈ 3 BYN. The actual cost in the Customer's local currency is determined by Telegram's rules and the exchange rate on the date of payment.
4.3. Package tariffs.
4.3.1. The Customer has the right to purchase the package tariff "Package −15%" or "Package −30%" with a one-time payment, providing savings on the cost of AI tales.
4.3.2. Unused AI tales from "Package −15%" and "Package −30%" tariffs remain valid for 60 (sixty) calendar days from the date of purchase. After this period, the unused balance is not subject to refund or compensation.
4.3.3. The Service Provider has the right to change the composition or cost of the package tariffs with at least 14 (fourteen) calendar days' notice to the Customer. Packages purchased before the change remain valid at the previous price and composition until fully used or expired.
4.4. Payment procedure:
4.4.1. Payment for the Services is made by the Customer exclusively via Telegram Stars using the payment infrastructure of the Telegram messenger.
4.4.2. The Customer independently purchases Stars to their personal account in the Telegram messenger via the App Store, Google Play, or other means provided by Telegram.
4.4.3. The Customer transfers Stars to the Service Provider through the built-in payment mechanism of the Telegram bot @tailesmebot by selecting a tariff and confirming the payment.
4.4.4. Telegram processes the payment and notifies the Service Provider's bot of successful payment.
4.4.5. The Service Provider credits the paid Services to the Customer and proceeds to deliver them.
4.5. The Service Provider does not accept payment from the Customer directly (including in cryptocurrency, by bank transfer, or in cash). All settlements between the Customer and the Service Provider are carried out exclusively through the Telegram payment infrastructure.
4.6. The Service Provider does NOT have access to the Customer's payment data (card numbers, bank details). All financial transactions are carried out through the Telegram payment infrastructure.
4.7. Full or partial payment for the Services is deemed an advance payment on account of the Services. In the event of the Customer's unilateral refusal of the Services, the provisions of Section 9 of the Agreement on refunds apply.
4.8. New Customers are granted 3 free AI tales and 1 free episode for familiarization.
4.9. The Services are provided only to the Customer (the minor for whose benefit the Services are provided). Transfer of rights to another person is not allowed.
4.10. Access to the Service. The Service is provided through the Telegram messenger. In certain regions, stable operation may require the use of VPN services. The Customer independently ensures connection to Telegram in accordance with the requirements of their jurisdiction. The Service Provider is not responsible for the inability to receive the Services due to restricted access to Telegram.
4.11. All expenses associated with the purchase of Stars and the use of Telegram infrastructure (App Store, Google Play, Telegram fees, etc.) are borne by the Customer.
5. Quality Control and Content Safety
5.1. The Service Provider controls the quality and integrity of content at all stages of creating a tale.
5.2. Each tale is checked for compliance with age norms (2–10 years), absence of profanity, aggression, and inappropriate content. Recordings by live actors undergo moderation.
5.3. Tales do not contain hidden advertising, product placement, mentions of brands, or links to third-party goods or services.
6. What the Service Provider NEVER Does
6.1. The Service Provider does NOT request personal data beyond what is necessary to create a tale (name, age, gender of the child). If anyone on behalf of tAIles.me requests documents, passport data, card numbers, or other confidential information — these are fraudsters. Do not share such data.
6.2. The Service Provider does NOT request or accept photographs of users or their children. The Service works only with textual information.
6.3. The Service Provider does NOT conduct hidden advertising and does not transfer data to third parties for marketing purposes.
6.4. The Service Provider does NOT accept payment from the Customer in cryptocurrency or by any means other than Telegram Stars.
7. Obligations and Rights of the Parties
The Service Provider undertakes to:
provide the Services with proper quality, in the volume and within the timeframe paid for by the Customer
act in the interests of the Customer (the minor)
notify the Customer of circumstances preventing the provision of the Services
ensure that the Services are provided by qualified employees and engaged persons
process personal data in accordance with the Law of the Republic of Belarus No. 99-Z dated 07.05.2021 and the Privacy Policy (tailes.me/privacy)
The Customer undertakes to:
make payment in accordance with the Agreement
provide accurate information necessary for the provision of the Services
not transfer the Materials to third parties and not use them for commercial purposes
The Customer is prohibited from:
circumventing the technical limitations of platforms
decompiling or disassembling the Website and Materials
creating copies or copying the design and content
altering the Website or its functioning
8. Liability of the Parties
8.1. The Service Provider does not guarantee uninterrupted access to the Service. The Service is provided on an "as is" basis. Software and hardware errors, power outages, internet network issues, actions of the Telegram messenger, and other infrastructure providers are not deemed improper performance of the Agreement.
8.2. The tales are intended for entertainment.
8.3. The Service Provider's maximum liability is limited to the amount actually paid for the order (or the cost of the package tariff). The Service Provider is not liable for indirect losses, including lost profits or moral damage, unless otherwise required by the mandatory rules of applicable law.
8.4. In the event of improper use of the Materials or Confidential Information (including unauthorized distribution, transfer to third parties, or commercial use), the Customer shall pay the Service Provider a penalty (fine) of 15,000 (fifteen thousand) Belarusian rubles. The penalty is of a punitive nature (paragraph 1 of Article 365 of the Civil Code of the Republic of Belarus): the Service Provider's losses, including direct damage and lost profits, shall be compensated by the Customer over and above the penalty in full pursuant to Article 14 of the Civil Code of the Republic of Belarus.
9. Refunds
9.1. AI Voice: a refund is made in the event of a technical error — if the tale was not created or was received in an unreadable form.
9.2. Human Voice / Live Video: a refund is made if the actor did not complete the order within 24 hours of payment.
9.3. Package tariffs: refunds for AI tales unused within the package validity period are not provided (clause 4.3.2).
9.4. Deadline for a refund request: 30 (thirty) calendar days from the date of payment. After 30 days, the Service Provider has the right to refuse a refund.
9.5. Refund procedure. The Customer shall:
send a request via Telegram @tailesme_support or to hello@tailes.me with the subject "REFUND REQUEST"
indicate the order number and justification
attach a digital payment receipt
9.6. The refund of funds (Stars or their equivalent) is made within and subject to the technical capabilities and rules of the Telegram payment infrastructure. Refund timeframes are determined by Telegram's rules. The Service Provider does not guarantee specific refund timeframes as these are beyond the Service Provider's control; however, the Service Provider undertakes to initiate the refund procedure within 10 (ten) business days of receiving a justified request.
10. Intellectual Property
10.1. The exclusive rights to all Intellectual Property (Services, Materials, Website, design, programs) belong to the Service Provider. Rights are protected in all forms and on all media.
10.2. The Customer receives a non-exclusive right to personal non-commercial use of the Materials. No other rights pass to the Customer.
10.3. Liability for infringement of Intellectual Property rights is governed by clause 8.4 of the Agreement.
11. Force Majeure
11.1. The Parties are released from liability in the event of force majeure circumstances: natural disasters, epidemics, pandemics, military actions, embargoes, decisions of governmental bodies, failures of data networks, blocking or restriction of the Telegram messenger, material changes in the service terms by Telegram, Fragment, or the Service Provider's technology providers.
11.2. If force majeure circumstances continue for more than 30 days, each Party has the right to terminate the Agreement with a refund for Services not rendered, in accordance with Section 9 of the Agreement.
11.3. The Party for which performance has become impossible shall, no later than 15 (fifteen) calendar days from the moment the circumstances arose, notify the other Party in writing (including via Telegram) and attach documents confirming the occurrence of the circumstances. Failure to give such notice, or late notice, deprives the Party of the right to rely on force majeure.
12. Applicable Law
12.1. This Agreement is governed by the laws of the Republic of Belarus, unless otherwise provided by mandatory rules of the law of the Customer's country of residence applicable to consumer relations.
12.2. Disputes are resolved through negotiations; if resolution is not possible — in the court of the Republic of Belarus at the Service Provider's location, unless otherwise required by mandatory rules of applicable law.
12.3. The personal data protection supervisory authority in the Republic of Belarus is the National Personal Data Protection Centre of the Republic of Belarus (NPDPC). Customers from the Russian Federation may also contact Roskomnadzor; Customers from the European Union — their national data protection supervisory authority (DPA).
12.4. This Agreement is effective from the moment of acceptance until the Parties have fully performed their obligations. For matters not regulated by this Agreement, the Parties are governed by the laws of the Republic of Belarus.
